Official Contest Rules for the
Visions Electronics “Win Your Purchase Salesperson” Contest
BY PARTICIPATING IN THIS CONTEST, ALL ENTRANTS AGREE TO BE BOUND BY THESE RULES.
The Visions Electronics “Win Your Purchase Salesperson” Contest (the “Retailer Contest”) is conducted by Fairstone, and is open to all employees at the participating retailer locations who meet the eligibility requirements set forth below (each, a “Retailer”).
The Retailer Contest runs from June 15, 2018 at 12:01:01 a.m. Eastern Time until July 31, 2018 at 11:59:59 p.m. Eastern Time (the "Contest Period") at participating Retailers.
In order to participate in the Retailer Contest, the following criteria must be met to the full satisfaction of Fairstone:
A Retailer must:
- Be currently participating in the Fairstone Revolving Charge Dealer program; and
- Be participating in the Visions Electronics Win Your Purchase Contest (the “Purchase Contest”), including promotion of that contest in the Retailer’s location(s).
A Retailer’s customer must:
- Meet the eligibility criteria of the Purchase Contest (each such customer, an “Eligible Customer”).
An employee of the Retailer (each, an “Entrant”) must:
- Be a legal resident of Canada;
- Have reached the age of majority in the province or territory of entry into the Retailer Contest at the time of entry;
- Be an employee and sales associate of the Retailer at all times during the Contest Period and until September 28, 2018 or such later date when a prize is awarded. Fairstone reserves the right to disqualify from the Retail Contest an employee of the Retailer who is not continuously employed by the Retailer during the period; and
- For the Grand Prize, have closed a sale with an Eligible Customer during the Contest Period.
- For each Secondary Prize, the sales associate’s customer must have submitted a new Vision Electronic credit card application.
Each entry for the Grand Prize or Secondary Prize is collectively a “Ballot”.
The Retailer Contest is not open to employees, representatives or mandataries of the Sponsor, or their respective parents, affiliates, subsidiaries, and individuals living in the same households of each of the above.
A general manager of the Retailer must:
- Ascertain the identity of the employee(s) on each Ballot based upon the sales information automatically registered in the Retailer’s point-of-sale computer system; such registered information must include each employee’s identification to allow a Retailer unambiguously determine the identity of the employee on the Ballot.
There are a number of prizes available to be won (each, a "prize" and collectively, the "prizes") across Canada during the Contest Period. The number of prizes will vary depending upon the value of each prize won. The total value of all prizes is $1,000.
The grand prize (“Grand Prize”) is $500. A prize may be subject to taxes, which will be the responsibility of the Contest winners.
SELECTION OF WINNERS
The sales associate that completed the sale to the winner of the Purchase Contest will be the Grand Prize winner.
In the event multiple sales associates have the same number of customer applications, a random draw will take place to select a winner from those sales associates.
The identification of the winners from sales data collected, and the random draw (if required), will take place on August 15, 2018 at 2:00 PM (EDT) at 255 Queens Avenue, Suite 1,000 London, Ontario N6A 5R8 and will be conducted by an independent judge whose decisions are final and binding in all matters relating to this Retailer Contest.
Each winner will be contacted by telephone and will be asked to provide his or her email, fax or mailing address to which a mathematical skill-testing question and a declaration and release form will be sent for completion by such winner. In the event that a winner (i) cannot be contacted after three (3) attempts, (ii) fails to correctly answer the skill-testing question, or (iii) fails to sign and return the declaration and release in the time period provided, he or she will forfeit the prize in question and a redraw from the remaining eligible entries will occur. The declaration and release forms to be completed by the selected Entrant pursuant to these Retailer Contest Rules must be returned within five (5) business days of issuance of notification. Non-compliance with any of the foregoing may result in disqualification and awarding of Prize to an alternate Entrant.
Entrants are automatically entered in the Retailer Contest.
During the Contest Period, all eligible customer purchases are automatically entered into the Retailer Contest. In the event of a full return by the customer (i.e. all of the items that were purchased are returned), the Ballot will be withdrawn from the Retailer Contest.
ALL POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A CONTEST WINNER OF ANY PRIZE, EVEN IF THE RETAIL CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL THE ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING SALE HAS BEEN VERIFIED AND THE ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
ODDS OF WINNING:
The odds of winning the Grand Prize depend upon the total number of Retailers participating in the Visions Electronics Win Your Purchase Contest and the number of sales transactions. The odds of winning a Secondary Prize depend upon the total number of Retailers participating in the Win Your Purchase Salesperson Contest and the total number of Vision Electronic credit card applications processed.
If the Retailer Contest Rules are met, in order to be declared a winner, a contest winner must have complied with all Retailer Contest Rules.
A contest winner must also correctly answer, unaided, a time-limited, mathematical skill-testing question, which will be administered by a Sponsor’s representative via email, fax, or mail. A contest winner must provide the answer to the skill-testing question within five business days of its receipt.
After the Sponsor verifies whether a contest winner has complied with the Retailer Contest rules, a contest winner must sign Fairstone's standard release form before being entitled to receive their prize. That form also contains a contest winner’s consent to the use of his or her name, address and/or photograph in advertising or other publicity by Fairstone and/or its agencies, without any payment or other compensation to the contest winner, including without limitation, publication on the Fairstone website(s), microsite(s) and e-newsletters, among other locations, of the Contest Winner’s name, the fact that the Contest Winner is an employee of the participating Retailer, that the Contest Winner is a Prize winner, any other basic biographical details the contest winner provides to Fairstone representatives when claiming his or her prize, and any statements the contest winner makes to Fairstone representatives regarding their prize, the Retailer Contest, or the contest winner’s thoughts/feelings about winning their prize (which may be quoted in a complete or an abridged format).
A contest winner must complete, (electronically) sign and return the standard release form to Fairstone within five (5) business days of receiving it or the contest winner may be disqualified from the Retailer Contest.
NOTIFICATION AND FULFILLMENT:
The contest winners will be notified by email on or about August 20, 2018 and the prizes will be awarded on or before September 28, 2018, or such other date as agreed by Fairstone and the selected Retailer’s general manager.
A prize must be accepted as awarded and cannot be transferred, exchanged, or substituted.
GENERAL TERMS AND CONDITIONS OF PARTICIPATION:
By participating in the Retailer Contest, each Entrant agrees:
a. To be bound by these Retailer Contest rules and the decisions of Fairstone, which decisions shall be final and binding;
b. To the unrestricted use, by Fairstone, in its discretion, or its agents, of his/her name and/or likeness, address, city/province or territory of residence, photograph, picture, portrait, voice, and ideas for advertising, promotional purposes, and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission, or notification, other than the value of the prize offered;
c. To sign a publicity release granting and acknowledging the rights of Fairstone, in its discretion, or its agents, to publish or broadcast the selected Entrant's picture, portrait, likeness, name, address, voice and statements for publicity purposes, without any further compensation, other than the value of the prize offered;
d. That, by entering the Retailer Contest, the Entrant releases Fairstone and the administrators and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any liability for loss, harm, damages, costs and/or expenses, arising out of or in any way connected with participation in the Retailer Contest, the awarding of the prize, the use of information as aforementioned, or the acceptance, use or misuse of a Prize, including, without limitation, loss, harm, damages, costs and/or expenses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom;
e. The Entrant will sign declaration and release forms, or such other supporting documentation that Fairstone may request, to give effect to such release upon request by Fairstone;
f. Fairstone is not responsible for lost, incomplete, illegible, late, or misdirected entries; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; interrupted or unavailable internet, email or satellite systems; errors in these rules; failures of electronic equipment, computer hardware or software; or inaccurate entry information, whether caused by equipment, programming used in the Retailer Contest, human processing error, or otherwise; and
g. Fairstone reserves the right, subject to any approvals required by law, to terminate or suspend the Retailer Contest in whole or in part, and at Fairstone's discretion, to not award a prize in a random draw from all entries received up until the date and/or time that the Retailer Contest terminated, for any reason, including, but not limited to, if events beyond its reasonable control make continuation not feasible, or if the integrity of the Retailer Contest is impaired for any reason including, but not limited to, the loss or destruction of ballots, if a virus, bug, computer, electronic or system malfunction, or if human error or another cause beyond Fairstone's control should corrupt the administration, security or fair play of the Retailer Contest. Fairstone also reserves the right, subject to any approvals required by law, to amend these Retailer Contest rules at any time and without notice to entrants for any reason, including, but not limited to, correcting clerical errors in the Retailer Contest rules or advertising materials. All of Fairstone's decisions concerning the Retailer Contest are final.
h. That pursuant to Section 5(10) of the Rules Respecting Publicity Contests (Quebec), any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
The Retailer Contest is subject to all applicable federal, provincial and municipal laws and regulations.
These are the Retailer Contest rules. These Retailer Contest rules are subject to change without notice. Fairstone reserves the right to amend, withdraw, or terminate all or any portion of this Retailer Contest at any time for any reason without prior notice. Fairstone reserves the right to cancel or suspend this Retailer Contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation. In the event of a conflict between these Retailer Contest rules published in the English language and these Retailer Contest rules published in the French language, the English language version shall prevail.
Any litigation respecting the awarding of a prize must be commenced in the City of Toronto, Ontario.
