Official Contest Rules for the Fairstone “Burgers and Bucks” Contests
BY PARTICIPATING IN THESE CONTESTS, ALL ENTRANTS AGREE TO BE BOUND BY THESE RULES.
THE CONTESTS: The Fairstone “Burgers Contest” and the “Bucks Contest” (collectively, the “Contest”) are conducted by Fairstone, and are open to all employees at participating** retailer locations who meet the eligibility requirements set forth below (each, a “Retailer”).
The Contest runs from October 1, 2017 at 12:01:01 a.m. Eastern Time until October 31, 2017 at 11:59:59 p.m. Eastern Time (the "Contest Period") at participating Retailers.
ELIGIBILITY: In order to be eligible to participate in the Contest, the Retailer must be currently participating in the Fairstone Revolving Charge Dealer program, and during the Contest Period, the Retailer’s customers must be approved for and successfully open at least three (3) Fairstone Revolving Charge accounts (each, an “Account”).
In order for a Contest ballot (as more particularly described below) to be valid, the participating employees of the Retailer must:
- Be a legal resident of Canada;
- Have reached the age of majority in the province or territory of entry into the Contest at the time of entry;
- Be an employee and sales associate of the Retailer at all times during the Contest Period and until December 29, 2017 or such later date when a prize is awarded. Fairstone reserves the right to disqualify from the Contest an employee of the Retailer who is not continuously employed by the Retailer during the period; and
- Have assisted a customer of Retailer in successfully applying for an Account during the Contest Period (each opened Account being a “Bucks Ballot”).
The Contest is not open to employees or representatives of the Sponsor, or their respective parents, affiliates, subsidiaries, and individuals living in the same households of each of the above. In addition, the Contest is not open to residents of Quebec.
Retailers are automatically entered into the Contest once they achieve the eligibility requirements above. Each Retailer is required to maintain records showing the unique employee number of the Retailer’s employee that assisted in opening the Account.
THE BUCKS PRIZE:
There are a number of cash prizes available to be won across Canada (excluding Quebec) during the Contest Period. The value of the bucks prizes will vary depending upon the number of Bucks Ballots received and the cash value given to each Bucks Ballot, calculated as follows, to a maximum of $17,500:
- A prize of $5 per Account will be awarded for Accounts that do not have a purchase charged to the Account during the Contest Period
- A prize of $10 per Account will be awarded for an Account that have a purchase charged to the Account during the Contest Period
Bucks prizes will be paid to the Retailer, and the Retailer will distribute funds to the employees that assisted Retailer’s customers in opening the Accounts.
THE BURGER PRIZE:
There are a total nine (9) food prizes of $250 each available to be won across Canada (excluding Quebec) during the Contest Period. The value of the food prizes totals $2,250. Each winning Retailer will be provided with a cheque for $250 that is to be used to purchase lunch for the Retailer’s employees. Three (3) food prizes will be awarded in each of three (3) regions, comprised of Ontario, the Maritimes and Western Canada. Should there not be any eligible Retailers in any one of region, a separate draw for the prizes for that region will be made from the eligible Retailers.
SELECTION OF WINNERS
All valid Bucks Ballots will result in a cash prize being awarded to the maximum indicated. Should the number of valid Bucks Ballots exceed the total prize money available, the prizes will be awarded based upon the time and date of sale, starting from the first day of the Contest Period and continuing until all prize funds are exhausted. The winners of the burger prize will be randomly selected from participating Retailers.
The identification of all Contest winners and the calculation of the total amount of Bucks prizes will take place on November 13, 2017 at 2:00 PM (EDT) at 255 Queens Avenue, Suite 1000, London, Ontario N6A 5R8 and will be conducted by an independent judge whose decisions are final and binding in all matters relating to the Contest. Each winning Retailer will be contacted by telephone and will be asked to provide an email, fax or mailing address to which a mathematical skill-testing question and a declaration and release form will be sent for completion by such winner. In the event that a winner (i) cannot be contacted after three (3) attempts, (ii) fails to correctly answer the skill-testing question, or (iii) fails to sign and return the declaration and release in the time period provided, that Retailer will forfeit any prizes in question. The declaration and release forms to be completed by the winning Retailer pursuant to these Contest Rules must be returned within five (5) business days of issuance of notification. Non-compliance with any of the foregoing may result in disqualification and awarding of prize to an alternate entrant.
The Retailer is required to ascertain the identity of the employee(s) on each Bucks Ballot based upon the sales information automatically registered in the Retailer’s point-of-sale computer system; such registered information must include each employee’s identification to allow a Retailer unambiguously determine the identity of the employee on the Bucks Ballot.
ALL POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A CONTEST WINNER OF ANY PRIZE UNLESS AND UNTIL THE ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND THE ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
ODDS OF WINNING: All valid Bucks Ballots will result in a cash prize being awarded. The odds of winning a Burger prize will vary depending upon the number of Retailers that participate in the Burgers Contest.
TO WIN: If the Contest Rules are met, in order to be declared a winner, a contest winner must have complied with all Contest Rules. A contest winner must also correctly answer, unaided, a time-limited, mathematical skill-testing question, which will be administered by a Sponsor’s representative via email, fax, or mail. A Contest winner must provide the answer to the skill-testing question within five business days of its receipt.
After the Sponsor verifies whether a contest winner has complied with the Contest rules, a contest winner must sign Fairstone's standard release form before being entitled to receive their prize. A contest winner must complete, (electronically) sign and return the standard release form to Fairstone within five (5) business days of receiving it or the contest winner may be disqualified from the Contest.
NOTIFICATION AND FULFILLMENT:
The contest winners will be notified by email on or about November 17, 2017 and the prizes will be awarded on or before December 29, 2017, or such other date as agreed by Fairstone and the selected Retailer’s general manager.
PRIZE RESTRICTIONS: A prize must be accepted as awarded and cannot be transferred, exchanged, or substituted.
GENERAL TERMS AND CONDITIONS OF PARTICIPATION: By participating in the Contest, each Retailer agrees:
a. That it and its participating employees will be bound by these Contest rules and the decisions of Fairstone, which decisions shall be final and binding;
b. That, by entering the Contest, the Entrant releases Fairstone and the administrators and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any liability for loss, harm, damages, costs and/or expenses, arising out of or in any way connected with participation in the Contest, the awarding of the prize, the use of information as aforementioned, or the acceptance, use or misuse of a Prize, including, without limitation, loss, harm, damages, costs and/or expenses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom;
c. The winning Retailer will sign declaration and release forms, or such other supporting documentation that Fairstone may request, to give effect to such release upon request by Fairstone;
d. Fairstone is not responsible for lost, incomplete, illegible, late, or misdirected entries; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; interrupted or unavailable internet, email or satellite systems; errors in these rules; failures of electronic equipment, computer hardware or software; or inaccurate entry information, whether caused by equipment, programming used in the Contest, human processing error, or otherwise;
e. Each Retailer winning bucks prizes agrees that it will distribute the prizes earned by its employees, without charge or modification, and that Fairstone will not be responsible for any income or other taxes that may be payable by Retailer or its employees regarding these prizes; each Retailer winning a burger prize agrees to host a lunch or other event for its employees at a cost equal to or greater than $250; and
f. Fairstone reserves the right, subject to any approvals required by law, to terminate or suspend the Contest in whole or in part, and at Fairstone's discretion, to not award a prize in a random draw from all entries received up until the date and/or time that the Contest terminated, for any reason, including, but not limited to, if events beyond its reasonable control make continuation not feasible, or if the integrity of the Contest is impaired for any reason including, but not limited to, the loss or destruction of ballots, if a virus, bug, computer, electronic or system malfunction, or if human error or another cause beyond Fairstone's control should corrupt the administration, security or fair play of the Contest. Fairstone also reserves the right, subject to any approvals required by law, to amend these Contest rules at any time and without notice to entrants for any reason, including, but not limited to, correcting clerical errors in the Contest rules or advertising materials. All of Fairstone's decisions concerning the Contest are final.
The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
These are the Contest rules. These Contest rules are subject to change without notice. Fairstone reserves the right to amend, withdraw, or terminate all or any portion of this Contest at any time for any reason without prior notice. Fairstone reserves the right to cancel or suspend this Contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation. In the event of a conflict between these Contest rules published in the English language and these Contest rules published in the French language, the English language version shall prevail.

JURISDICTION: Any litigation respecting the awarding of a prize must be commenced in the City of Toronto, Ontario.
